College or University Department Site License Agreement for the Green Globs & Graphing Equations Package

"Licensor" means "Dugdale and Kibbey Consulting, Inc." "You" and "your" mean the License Holder, the purchaser of the license. "Licensed Computers" are the computers under the administration of the college or university department that is named on your invoice. "Software" means all files and their contents that you receive from Licensor, now or in the future, designated by Licensor as part of the Green Globs & Graphing Equations Package.

The Software is the sole and exclusive property of Licensor, which retains copyright ownership. This license does not transfer ownership of the Software to you. You receive a license to use the Software under the conditions of this License Agreement. You agree not to sell, rent, lease, or sublicense the Software. You agree not to distribute the Software in any manner not explicitly allowed by this License Agreement. You agree not to disassemble, decompile, or otherwise reverse engineer the Software. You agree not to attempt to circumvent security measures in the Software.

You may install and use the Software on all Licensed Computers. You may allow an individual authorized to use the Software on one or more of the Licensed Computers to make a copy of the Software to install on a computer that is not one of the Licensed Computers, provided the copy is not for distribution or transfer, the copy is only for the individual's personal use related to your use of the Software, and the individual agrees to the conditions of the license. The individual may be a student, staff member, student teacher, classroom assistant, workshop participant, or other user authorized to use the Software on one or more of the Licensed Computers.

The Software is provided to you "as is". Licensor does not guarantee or warranty the suitability of the Software for any specific users or situations. All decisions concerning the suitability of the use of the Software for specific users and situations are entirely your responsibility and your liability.

For a period of one hundred eighty (180) days from the date of your receipt of the Software, you may reject the Software and receive a full refund of your purchase price. If you reject the Software, you agree to destroy all copies made as part of implementing the license. Licensor's entire liability and your exclusive remedy shall be return of the purchase price.

This Agreement constitutes the entire agreement between you and Licensor, and it is governed by the laws of the State of Illinois and the United States of America.
